You should carefully read the following Terms and Conditions. Your purchase or use of our products or services implies that you have read and accepted these Terms and Conditions.

License

JoomItaly grants you non-exclusive limited license to use the extensions and other products sold through our web site (the "products") in accordance with these Terms and Conditions (the "license").

Limited Use Granted

You may use each individual product on one website only, belonging to either you or your client. You have to purchase the same extension again in order to use it for more than 1 website.

Modifications

You are authorized to make any necessary modification(s) to our products to fit your purposes. You may not however redistribute or release any modifications as GPL or otherwise. You must also not change or remove the copyright information in the XML descriptor or HTML/CSS/Javascript/PHP files, as well as the product version inside HTML comments on PHP files. Porting our products to other platforms and content management systems and redistributing as GPL or otherwise is also strictly prohibited. Please contact us if you have any requirements that are not covered by these terms.

Unauthorized Use

You may not place any of our products, modified or unmodified, on a diskette, CD, website or any other medium and offer them for redistribution or resale of any kind without prior written consent from JoomItaly.

Updates

Reperibility of updates of the same product series are grant to all valid customer during their subscription period. Updates will be available for the time and for the product series specified in the purchased subscription plans. For example, if you purchase version 1.2 of one of our products, you are entitled to download updates of all 1.x product versions released during your subscription period, but not of 2.x, 3.x and so on. Once your subscriptions expire updates of extensions will become unavailable until renewal of the subscription plans. Please also note that our products are always developed for the latest stable versions of Joomla!. If there are any exceptions, we will always make sure to clearly state so in our product descriptions. When a new version of one of our products is released, it is published in our download area. Just login or follow the password reminder procedure. If your subscription has exipred, just renew it.

File Delivery

The payment process is fully automated. After you purchase a product through Paypal, click on the "complete purchase" link to instantly download the product.

Assignability

You may not sub-license, assign, or transfer this license to anyone else without prior written consent from JoomItaly.

Ownership

You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of JoomItaly. Our products are provided "as is" without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.

Use of Content

You acknowledge that all JoomItaly sites contain or may contain material (collectively the "Content") which is protected by copyright, trademark or other proprietary rights. You may not transfer or sell, reproduce, create derivative works from, distribute, or in any way exploit any of the Content, in whole or in part, except with an expressly permitted agreement from JoomItaly or their respective creators.

Return/Refund Policy

Since our company is offering non-tangible irrevocable goods we do not issue refunds after the product is shipped, which you are responsible for understanding upon purchasing. Please make sure that you've carefully read all relevant documentation and tried out the demos.

Support

JoomItaly offers commercial extensions "as is", with no implied meaning that they will function exactly as you wish or with all 3rd party extensions. Further, we offer no support via email or otherwise for installation, customization, administration of Joomla! etc. The official customer-to-customer Support Forum is available to everyone seeking for help. However JoomItaly commits to monitor the forum, providing additional assistance and guidance.

ADVANCED Support

The purchase of each product may incslude the possibility to access to a pecific support section of the JoomItaly Forum where to obtain dedicated support from the JoomItaly staff. This special support is limited to the extensions and for the time specified in the supscription plans purchased by the customers. Once the subscription expires, access to dedicated support forum section will become unavailable until renewal of the subscription plans.

Warranty

JoomItaly does not warranty or guarantee these products in any manner. We cannot guarantee they will function with all 3rd party extensions or templates as there is currently no certification process for such extensions or templates. All JoomItaly products are tested to work on all major browsers, including Mozilla Firefox (and all Gecko based browsers, e.g. Flock), Microsoft Internet Explorer (and all Trident based browsers, version 6 and newer), Opera, Apple Safari (version 3 and newer, as well as all WebKit based browsers).

Controlling Law and Jurisdiction

THIS LICENSE SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF COURTS IN VENICE, ITALY, WITHOUT REGARD TO CONFLICTS OF LAWS PROVISIONS. YOU HEREBY AGREE AND CONSENT THAT THE SOLE AND EXCLUSIVE JURISDICTION FOR ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATING TO THIS LICENSE SHALL BE A COURT LOCATED IN VENICE, ITALY.
